SANParks, as a state institution is governed by relevant Government policy and legislation including the Public Finance Management Act (Act 1 of 1999).
Section 16.1 of the PFMA prescribes a private party that wants to make use of state property for commercial purposes needs to enter into a Private Public Partnership (PPP) agreement with the relevant state institution. In order for this agreement to be effective it needs to be preceded by a PPP process that entails a transparent and fair tender process as laid down by the PPP Toolkit for Tourism that can be accessed on the website www.ppp.gov.za.
Section 41 of the National Environment Management: Protected Areas act, (Act No 57of 2003) gave existence to the Garden Route National Park and granted it the powers to manage the following areas,
All entities that are operating commercial activities in demarcated areas of the Garden Route National Park must be in possession of a valid Permit/ Operating License / Agreement. An entity that is operating without any of these is running an illegal venture in the Park and may face prosecution.
